1. Definitions

• Platform: Refers to the Neigh website and associated services.

• Seller: A registered user listing a horse or related services for sale.

• Buyer: A registered user interested in purchasing a horse or related services.

• User: Any individual or entity using the platform, including buyers, sellers, and visitors.

• Listing: Any horse or service advertised on the platform.

2. General Use

• Users must be at least 18 years old to create an account and use the platform.

• All information provided during registration and use of the platform must be accurate, complete, and up-to-date.

• Users are responsible for maintaining the confidentiality of their account credentials. Neigh is not liable for unauthorised access resulting from user negligence.

3. Horse Listings

3.1 Listing Requirements

• Sellers must provide accurate and truthful information about the horse, including but not limited to:

  • Name, breed, age, height, gender, color, and any distinguishing features.

  • Health history, including vaccinations, worming, dental care, and any past or current medical conditions.

  • Behavioral traits, training level, and suitability for specific riders or disciplines.

  • Passport information, which will be securely stored and used solely for verification purposes.

• Sellers must disclose any known quirks, vices, or behavioral issues, as well as any relevant history (e.g., ex-racehorse).

• Sellers must not list horses for purposes that violate welfare standards or laws, such as for slaughter or banned practices.

• Sellers may list a horse on behalf of the owner, however, Neigh is not responsible for fraudulent listings that are not agreed by the owner.

3.2 Prohibited Listings

• Fake or misleading listings are strictly prohibited.

• Duplicate listings for the same horse are not allowed unless explicitly approved by Neigh.

• Listings flagged for welfare concerns may be removed without notice.

4. Selling Horses

4.1 Seller Responsibilities

• Sellers must have legal ownership of the horse or the authority to sell it.

• Sellers must ensure the horse is in suitable condition for sale, including ensuring its health and safety during viewings and transport.

• Sellers must transfer all necessary documentation, including the horse’s passport, to the buyer upon completion of the sale.

4.2 Buyer-Seller Agreements

• Any agreements regarding payment, trial periods, or conditions of sale are made directly between the buyer and seller. Neigh is not responsible for enforcing these agreements.

• Neigh is not liable for disputes arising from private agreements outside the platform.

5. Welfare Standards

• Neigh is a welfare-first platform. Sellers must adhere to the highest standards of care and disclose any welfare concerns.

• Listings flagged for potential welfare violations may require additional verification, including veterinary records or photos.

• Neigh reserves the right to suspend or terminate accounts for welfare violations.

6. Payments

• Neigh does not process payments between buyers and sellers. All transactions must be handled directly between the parties.

• Neigh is not liable for payment disputes, non-payment, or fraudulent transactions.

• Any deposit or trial agreements are made at the buyer and seller’s discretion.

7. Communication

• Users are encouraged to communicate through the platform to ensure transparency and recordkeeping.

• Neigh is not responsible for issues arising from communications conducted within the platform or outside of the platform.

• Abusive or inappropriate behavior in messages will result in account suspension or termination.

8. Data Protection and Privacy

• Neigh complies with applicable data protection laws, including GDPR.

• Personal information, including passport details, is stored securely in an encrypted database.

• Neigh will not share personal data with third parties without user consent, except as required by law.

9. Liability

9.1 Platform Errors

• Neigh is not liable for technical errors, downtime, or disruptions that may impact listings or user experience.

9.2 Disputes

• Neigh is not responsible for resolving any disputes between buyers and sellers. Users are encouraged to resolve disputes amicably and in good faith.

9.3 Third-Party Services

• Neigh is not liable for the performance or reliability of third-party services (e.g., transport, veterinary care) recommended or accessed through the platform.

10. Prohibited Activities

• Users may not:

  • List horses or services in violation of applicable laws or welfare standards.

  • Engage in fraudulent or deceptive practices.

  • Use the platform to harass, threaten, or defraud others.

  • Attempt to access or compromise the platform’s security.

11. Termination of Accounts

• Neigh reserves the right to suspend or terminate accounts for:

  • Violations of these Terms and Conditions.

  • Reports of fraudulent activity or welfare concerns.

  • Abuse of the platform’s features or other users.

12. Modifications to Terms and Conditions

• Neigh reserves the right to update these Terms and Conditions at any time. Users will be notified of significant changes via email or platform notifications.

• Continued use of the platform constitutes acceptance of updated terms.

13. Governing Law

• These Terms and Conditions are governed by the laws of the United Kingdom.

• Any legal disputes arising from the use of Neigh will be subject to the exclusive jurisdiction of the courts in The United Kingdom.
